Various types of conduct can be considered criminal, and, depending on the circumstances, may be charged as misdemeanors or felonies. When the State prosecutes a traffic crime, it must prove beyond a reasonable doubt that the defendant's alleged acts meet the elements of the offense. Although the prosecution may have evidence to support their arguments, it does not mean it's enough to convince a judge or jury of guilt. Defenses may be raised to challenge the accusations.

  • Hit and run: When a person is in an accident, they are legally required to exchange information with others involved. The law applies whether or not the individual was at fault. The penalties imposed for failing to fulfill this requirement depend on the circumstances. For instance, if a person or occupied vehicle was struck and no death or injury resulted, the punishments include up to 6 months' imprisonment and/or a fine between $300 and $1,000. The penalties increase to a maximum term of imprisonment of 9 months and a fine of up to $10,000 if injury occurred. If great bodily harm or death resulted, the punishments increase even further.
  • Eluding an officer: If a law enforcement official signals a person to pull over and they knowingly fail to do so, they can be charged with a Class I felony. The punishments include up to 3 years and 6 months' imprisonment and/or a fine of up to $10,000. If the conduct resulted in bodily harm or property damage, the offense is a Class H felony, which carries a maximum prison term of 6 years and/or a fine of up to $10,000. If great bodily harm resulted, the accused could spend up to 12 years and 6 months behind bars and be ordered to pay a fine of up to $25,000. They may be facing up to 15 years' imprisonment and or a fine of up to $50,000 for fleeing an officer and causing the death of another.
  • Reckless driving: It is unlawful for a person to negligently operate a vehicle with a disregard for the safety of others. Depending on the circumstances, a conviction may result in a fine of up to $1,000 or a prison sentence of up to 3 years and 6 months and/or a fine of up to $10,000.
