Homicide Defense in Wisconsin
In general, homicide is defined as taking another person's life. In Wisconsin, various acts that result in someone else's death fall under this term. Our defense lawyers have handled numerous cases and know how to skillfully navigate the judicial process and effectively cast doubt on the prosecutor's evidence.
We work together as a team to provide high-quality legal representation for homicide offenses, including, but not limited to:
- First-degree intentional homicide, which occurs when a person causes someone else's death and they intended to do so. A conviction can result in a person term of life.
- First-degree reckless homicide, which is charged when a person engages in actions showing utter disregard for the lives of others and they cause death as a result. They may also be charged if they make, sell, or administer a controlled substance that kills another. If they're judged guilty, they could spend up to 60 years in prison for this Class B felony.
- Second-degree intentional homicide, which occurs when someone intentionally kills another but the mitigating circumstances for first-degree intentional homicide were not present. The punishments include up to 60 years' imprisonment.
- Second-degree reckless homicide, which is levied against a person accused of recklessly causing someone else's death. The offense is punishable by up to 25 years in prison and/or up to $100,000 in fines.
- Felony murder occurs when a person causes someone's death while committing or attempting to commit another crime. If they're convicted, the maximum term of imprisonment for the underlying offense is increased by up to 15 years.
- Homicide by intoxicated use of a vehicle or firearm, which is charged when someone operates a vehicle or handles a gun while under the influence of drugs and or/alcohol and causes another’s death. This is a Class D felony, which is penalized by up to 25 years' imprisonment and/or a fine of up to $100,000. The charge elevates to a Class C felony when the person had one or more prior convictions. In this case, the penalties include a maximum 40-year prison sentence and/or a fine of up to $100,000.
- Vehicular homicide, which is charged when someone negligently operates a vehicle and causes someone else's death. This is a Class G felony that is punishable by a maximum prison sentence of 10 years and/or a fine of up to $25,000.
